Terms of Use Agreement

The STEM Intercommunity Portal website (“SIP-Hawaii”) at is operated by Referentia Systems Incorporated under contract to the University of Hawaii Manoa College of Engineering and the Office of the Vice-Chancellor for Research and Graduate Education collectively referenced herein as (“Administrators”).  It is funded in part by Act 111 of the Hawaii State Legislature, fostering inspiration and relevance through science and technology (FIRST) pre-academy initiative.

SIP-Hawaii is a social networking website that allows participants to create and share information regarding personal profiles, organizations, events, web resources, groups, forums and other user-created content.  By accessing SIP-Hawaii or by subscribing to an RSS or email feed from the site, you signify that you have read, understand and agree to be bound by this Terms of Use Agreement ("Agreement") whether you access the site as a registered user or as an unregistered guest.  We reserve the right, at our sole discretion, to change, modify, add or delete portions of this Agreement.  Your continued use of SIP-Hawaii after any changes constitutes your acceptance of the revisions.  If you do not agree to abide by this or any future Terms of Use Agreement, do not use or access SIP-Hawaii.

This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of SIP-Hawaii including the features for collaboration and for generating user content (“User Content”).  Please read all of the Agreement carefully as it contains important information regarding your legal rights, remedies and obligations.

1        User Content Posted on SIP-Hawaii

All content posted on SIP-Hawaii is created and uploaded by registered users as a voluntary activity to promote and enhance Science, Technology, Engineering and Mathematics in Hawaii and beyond.  The SIP-Hawaii Administrators assume no liability for content posted by users whether prohibited as defined in this Agreement or otherwise unauthorized or objectionable to other users.  If you suspect misuse of the SIP-Hawaii site, please click on the “Contact SIP-Hawaii” link on any page.

The SIP-Hawaii Administrators reserve the right, at their sole discretion, to reject, refuse or remove any User Content posted to the site.  The Administrators may also deny, restrict, suspend or terminate your access to all or part of SIP-Hawaii at any time, without liability, if there is a suspicion that you have violated the terms of this Agreement.

When you post User Content to the site, you automatically grant to SIP-Hawaii, and you represent and warrant that you have the right to grant, an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license to use, copy, reformat, translate, excerpt and distribute such User Content for any non-commercial purpose.  If you choose to remove your User Content from the site, then the aforementioned license will automatically expire.

Due to the Children's Online Privacy Protection Act of 1998 (, you must be at least thirteen (13) years of age to use this Service. You must provide current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service. You are responsible for maintaining the confidentiality of your Service password and account, and are responsible for all activities that occur thereunder. SIP-Hawaii reserves the right to refuse service to anyone at any time without notice for any reason. 

2        Prohibited User Content

The SIP-Hawaii Administrators may reject, refuse to post or delete any User Content for any or no reason, including User Content that in the sole judgment of the Administrators violates this Agreement or which may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity. The Administrators assume no responsibility for monitoring SIP-Hawaii for inappropriate User Content or conduct. If at any time the Administrators choose, in their sole discretion, to monitor the website, they nonetheless assume no responsibility for the User Content, no obligation to modify or remove any inappropriate User Content, and no responsibility for the conduct of the User submitting any such User Content.  The following are examples of the kind of User Content that is prohibited on SIP-Hawaii.  The Administrators reserve the right to change or expand the definition of prohibited User Content at any time and to delete, alter or remove content which falls under this revised definition.

User Content is prohibited on SIP-Hawaii which:

  • Intimidates, harasses or advocates harassment of another person
  • Is violent in nature or advocates violence against others
  • Exploits people in a sexual manner or advocates sexual exploitation
  • Promotes racism, bigotry, hatred or physical harm against any group or individual
  • Contains nudity, excessive violence or offensive subject matter or contains links to sites containing such content
  • Furthers or promotes any criminal activity or provides information which supports or advocates the conduct of criminal or illegal activity
  • Infringes or otherwise compromises another person’s copyrighted work, such as providing pirated music or computer programs
  • Creates a security or privacy risk to any person, such as posting another person’s password, social security number or credit card number
  • Misrepresents your age, identity, or affiliation with the site or impersonates any other person
  • Transmits or otherwise promotes unsolicited or unauthorized advertising, solicitations and promotional materials often referred to as “spam” or “junk mail”
  • Libels or defames another person or organization
  • Solicits personal or contact information from anyone under eighteen (18) years of age
  • Constitutes information that is deliberately false or misleading
  • Involves commercial sales or promotion of for-profit enterprises in a manner unrelated to the mission or purpose of SIP-Hawaii
  • Circumvents, modifies or compromises the appearance and informational content of the SIP-Hawaii site in a manner not provided by the tools and features of the site, otherwise known as “hacking”.
  • Using SIP-Hawaii in any way that is inconsistent with applicable laws and regulations.

3        Eligibility and Registration

Registered participation in SIP-Hawaii is intended for users who are eighteen (18) years of age or older.  SIP-Hawaii content should be suitable for viewing by users thirteen (13) to eighteen (18) years old as part of a middle school or high school Science, Technology, Engineering and Mathematics course or after school activity. Users younger than eighteen (18) years older are prohibited from creating a new account and logging in as a full participant of SIP-Hawaii.  By using SIP-Hawaii as a registered user, you represent and warrant that you are 18 or over and that you agree to and abide by all the terms of this Agreement.  Accessing the SIP-Hawaii site as an anonymous guest user also means you agree to abide by the terms of this Agreement.

4        Copyrights and Other Intellectual Property

SIP-Hawaii honors the intellectual property rights of others and prohibits users from uploading, embedding, posting, or otherwise making available any material that infringes upon ay copyright, patent, trademark, trade secret or intellectual property right of another person or entity.  The SIP-Hawaii Administrators will promptly remove or disable access to information that we deem, in our sole discretion, is in potential or actual violation of intellectual property rights.  Any complaints regarding potential intellectual property infringement should be directed to the “Contact SIP-Hawaii” link on any page.

5        Disclaimer

The SIP-Hawaii Administrators are not responsible for and make no warranties, express or implied, as to the User Content or the accuracy and reliability of the User Content posted on or through SIP-Hawaii.  SIP-Hawaii User Content may contain links to other websites.  The Administrators are not responsible for the content, accuracy or opinions expressed on such websites, and such websites are not necessarily investigated, monitored or checked for accuracy or completeness by the Administrators.  Inclusion of any linked website on SIP-Hawaii does not imply approval or endorsement of the linked website by the Administrators.  When you access these third party sites, you do so at your own risk.

The SIP-Hawaii Administrators assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User Content. The Administrators are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or through the use of SIP-Hawaii.  SIP-Hawaii is provided “As-Is” and as available and the Administrators expressly disclaim any warranty of fitness for a particular purpose, non-infringement, or any other specific results from the use of SIP-Hawaii.

6        Liability

Under no circumstances are the Administrators responsible or liable in ay way to you or any third party for any loss or damage resulting from the use of SIP-Hawaii including attendance at any events listed on SIP-Hawaii or from any other content on SIP-Hawaii. 

7        Indemnity

You agree to indemnify and hold the SIP-Hawaii Administrators, associated organizations and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of SIP-Hawaii in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth in this Agreement and/or if any User Content that you post on SIP-Hawaii causes liability to another.

8        Other

This Agreement is accepted upon your use of SIP-Hawaii and is further affirmed by you becoming a registered user. This Agreement constitutes the entire agreement between you and the Administrators regarding the use of SIP-Hawaii. The failure of the Administrators to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
